Effective Date: January 1st, 2026Welcome to Kwala! Please read these Terms of Use carefully before using the app. By accessing or using Kwala, you agree to be bound by these Terms. If you do not agree, please do not use the app.
1. Acceptance of Terms
By accessing or using Kwala, you agree to these Terms of Use. If we update or revise these Terms, your continued use of the app constitutes acceptance of the updated Terms.
2. Services Provided
Kwala is a mobile platform that currently provides:
- Meal delivery to your door via independent delivery contractors.
- Takeaway or pickup orders at partner restaurants.
- Restaurant browsing and menu exploration.
- Future features may include table reservations and dine-in ordering.
Kwala facilitates orders and delivery but does not prepare food. Partner restaurants are solely responsible for food quality, preparation, and order accuracy.
3. User Accounts
To use Kwala, you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Users under 16 are not permitted to create accounts in accordance with our Privacy Policy. Users are responsible for providing accurate and up-to-date information.
4. User-Generated Content
You retain ownership of any content or data you create while using Kwala, including preferences, usage statistics, and meal customizations. By using Kwala, you grant us permission to collect and use anonymized and aggregated data solely for the purpose of improving the app and its services. No personal identifying information will be shared without your consent.
5. Acceptable Use / User Conduct
You agree not to:
- Violate any applicable laws or infringe the rights of others.
- Harass, abuse, or threaten delivery contractors, restaurant staff, or other users.
- Place fraudulent, misleading, or fake orders.
- Attempt to reverse-engineer, hack, or disrupt Kwala or its services.
Repeated or serious violations may result in warnings, temporary suspension, or permanent termination of your account at Kwala’s sole discretion.
6. Orders, Payments & Cancellation
Payment Methods: Currently, you can pay via cash on delivery or NFC tap-to-pay. In-app credit card payments are not yet available and may be added in a future update.
Order Responsibility: Partner restaurants are responsible for preparing and delivering orders accurately. Kwala only facilitates the order process and does not prepare food.
Cancellations: Please consult our Cancellation Policy within the app.
7. Communications
Kwala may send you notifications regarding your orders, app functionality, and other operational updates. You may also opt in to receive marketing communications. Your marketing preferences can be modified or withdrawn at any time via your account settings.
8. Privacy & Data Handling
Kwala collects only the information necessary to provide its services.
Delivery contractors can access only the data required to deliver orders accurately. Once the delivery is completed, their access to your personal information is revoked. Any misconduct by delivery contractors should be reported to Kwala support.
Restaurants can access only the orders they are preparing, including the total amount and payment method.
Personal information (such as name, phone number, and address) is shared only as necessary to fulfill orders. We respect your privacy and do not disclose unnecessary data to other users or third parties.
9. Disclaimer
Kwala is provided “as-is”. While we strive for quality and reliability, we do not guarantee that the app will always be error-free, uninterrupted, or available. Any meal suggestions, insights, or notifications are for informational purposes only and do not constitute medical, nutritional, or professional advice. Kwala is not responsible for the quality, safety, or timely delivery of food. These remain the responsibility of partner restaurants and independent delivery contractors.
10. Limitation of Liability
To the maximum extent permitted by law, Kwala shall not be liable for any direct, indirect, incidental, or consequential damage arising from your use of the app, including:
- Issues with food quality, preparation, or accuracy.
- Delivery delays, errors, or failures.
- Actions or errors by third parties, including restaurants or delivery contractors.
11. Governing Law & Dispute Resolution
These Terms of Use are governed by the laws of Morocco. We encourage users and Kwala to resolve disputes amicably. If a dispute cannot be resolved through friendly discussion, it may be submitted to the competent courts of Morocco for resolution.
12. Changes to the Terms
We may update these Terms from time to time. Significant changes will be communicated via in-app notifications, email, or in-app banners. Continued use of Kwala after updates constitutes your acceptance of the revised Terms.
